Terms of Use

These Terms of Use (“Terms”) govern your use of the Tourision platform and the associated services. By registering for the Service or using the Service, you accept these Terms.

Description of the Service

Tourision is a cloud-based software service (SaaS) that makes it possible to create, edit, brand and publish interactive virtual tours from 360° panoramic photos and to view visitor statistics. The Service is primarily aimed at businesses (B2B).

Account and Responsibility

• You are obliged to provide accurate and up-to-date information during registration.
• You are responsible for keeping your account details and password confidential; the transactions carried out through your account are attributable to you.
• If you notice that your account is being used without authorisation, notify us immediately.

Content and Intellectual Property

• You are the owner of all content you upload (photos, images, logos, text). You grant Tourision only a limited licence to host, process and display this content solely for the purpose of providing the Service.
• You warrant that you hold the necessary rights to the content you upload and that it does not infringe the rights of third parties (including copyright, trademark, personality rights and KVKK, the Turkish Data Protection Law). Obtaining the necessary permissions regarding the persons and private properties appearing in your tours is your responsibility.
• The Tourision platform itself (software, interface, brand, logo) belongs to Tourision and is protected by intellectual property legislation.

Acceptable Use

Prohibited Content

• Uploading content that is unlawful, misleading, defamatory, obscene or that infringes the rights of third parties

Security Violations

• Attempting to test, circumvent or disrupt the security of the Service
• Reverse engineering

Unauthorised Uses

• Using the Service for spam, the distribution of malicious software or unauthorised data collection
• Reselling or sublicensing the Service without our written permission

Subscription, Fees and Cancellation

• The Service has free and paid plans. Paid plans are offered under a subscription model aimed at businesses, and payments are collected through Stripe.
• Subscriptions renew at the end of the period unless cancelled.
• In the event of cancellation, the Service may be used until the end of the paid period.
• Plan limits (number of tours, number of scenes, etc.) apply according to the selected package.

Service Level and Changes

We make reasonable efforts to provide the Service without interruption; however, temporary outages may occur due to maintenance, updates or unforeseen circumstances. We may improve or change the features of the Service, or discontinue it with reasonable prior notice.

Termination

The User’s Right of Termination

You may delete your account at any time via Settings.

Tourision’s Right of Termination

In the event of a breach of these Terms, we reserve the right to suspend or terminate your account. Except in cases of serious breach, a warning is given first where possible.

Limitation of Liability

The Service is provided “as is”. To the maximum extent permitted by the applicable legislation, Tourision cannot be held liable for indirect, incidental or consequential damages (including loss of profit, loss of data and business interruption).

Tourision’s total liability is limited to the amount you paid for the Service in the 12 months preceding the relevant claim.

Governing Law

These Terms are governed by the law of the Republic of Türkiye. In disputes, the courts and enforcement offices of Istanbul have jurisdiction.
